MOUNT VERNON — A Knox County grand jury indicted a Mount Vernon man for alleged burglary, violating a protection order, sexual imposition and three counts of aggravated menacing during its most recent session.

The grand jury charged David L. McElroy III, 28, with a second-degree felony for the burglary charge, a third-degree felony for the protection order violation, a third-degree misdemeanor for the sexual imposition charge and a first-degree misdemeanor charge for each aggravated menacing charge.

McElroy allegedly committed each of the crimes on or about Nov. 21, 2025.

The defendant “did commit sexual imposition, by having sexual contact with [redacted],” the indictment states.

The court has not scheduled an arraignment yet, but has issued a warrant to the Knox County Sheriff’s Office.

The grand jury indicted five other individuals during its most recent session.

— Joseph M. Gibson, of Newark, having weapons while under disability, a third-degree felony; forfeiture specification as to count one.

— John D. Burnside II, of Mount Vernon, strangulation, a third-degree felony; domestic violence, a first-degree misdemeanor.

— Wayne Kirk, of Centerburg, operating a vehicle under the influence of alcohol, a first-degree misdemeanor; aggravated possession of drugs, a fifth-degree felony.

— Trent W. Tiell, of Bettsville, operating a vehicle under the influence of alcohol, a first-degree misdemeanor; failure to comply with the order or signal of a police officer, a third-degree felony.

— Olivia J. Smith, of Mount Vernon, operating a vehicle under the influence of alcohol, a first-degree misdemeanor; tampering with evidence, a third-degree felony.
