MOUNT VERNON — The Mount Vernon Municipal Planning Commission unanimously approved a conditional use permit recently that clears the way for a mixed-use creative arts space in a private residence.

Nicole Miller uses her 1860s historic home at 105 W. Pleasant St. primarily for her photography work. She also hosts an annual arts and vintage market, Market at the Manor.

She requested a conditional use to support educational workshops, classes, and other community arts and cultural gatherings.

Neighbors Mark and Erin Fitzpatrick support Miller’s request.

At the May planning commission meeting, Erin Fitzpatrick said Miller’s work on the property brings up neighborhood property values and that previous markets have been respectful and nonintrusive.

Mark Fitzpatrick said Miller’s renovations have been impressive and have moved the neighborhood in a good direction.

Both agreed that parking has not been an issue.

Olivia Toth, executive director of the Knox County Convention & Visitors Bureau, testified that she likes to see cultural events such as what Miller proposes. She said an October event aligns with other community events.

Arts center must comply with lighting, noise, and other conditions

City Inspector Scott Zimmerman suggested that commission members might want to put parameters on the size and hours of operation if they grant a conditional use.

Commission members approved the conditional use at their June 4 meeting, subject to conditions.

Approved uses include artisan and makers markets, small private events, workshops, and photography and creative studio operations.

Indoor events are limited to 35 people and outdoor events to 50 people. Makers markets are limited to 50 attendees at one time.

The commission also set a maximum of four events per month or 24 events annually for events with 20 to 50 attendees.

Outdoor events must end by 9 p.m. No DJs, live bands, or bass-heavy sound systems are permitted outdoors.

Lighting must be fully shielded, directed downward, and not spill onto adjacent residential properties.

Alcohol must comply with state laws, and outdoor consumption is prohibited after 10 p.m.

The conditional use transfers with the property if Miller sells it, provided there is no six-month period of inactivity.
